Welcome to the terms of purchase for Bon Vivant Online Store. These terms regulate your purchases of goods on our website. It is important that you read and understand these terms before making a purchase. Your purchase is subject to these terms as well as applicable laws and regulations.

1. Agreement

The purchase agreement is entered into between you as the buyer and Bon Vivant Online Store, based on the information provided in the ordering process on our website, any direct correspondence between us, and these terms of sale. In the event of any conflict between the information in the ordering process, correspondence, and terms of sale, the information in the ordering process shall prevail, unless it contradicts applicable law. It is important to note that Bon Vivant Online Store cannot enter into agreements with minors without consent from their legal guardians, and a binding purchase agreement can only be entered into with individuals over 18 years of age.

2. Parties

Seller:

  • Company Name: Bon Vivant AS
  • Email: post@bonvivant.no
  • Phone Number: +47 901 95855
  • Organization Number: 918 046 372

Buyer is the person placing the order.

3. Prices

The prices stated on the website include value-added tax for end consumers, except in the B2B section where prices are stated without VAT. Bon Vivant reserves the right to correct price errors on the website. The total price, including all costs (value-added tax, customs, delivery charges, etc.), is clearly stated in the ordering process before you complete the purchase. For orders outside of Norway, customs and local taxes may apply.

4. Conclusion of Agreement

The purchase agreement is binding for both parties when your order is received by the seller. The seller reserves the right to correct any typographical or typographical errors in price information. An order confirmation will be sent to you after the order is received.

5. Payment

Payment for the goods may be required at the time of ordering. We accept payment in Norwegian Kroner (NOK) within Norway and in US Dollars (USD), Euros (EUR), and British Pounds (GBP) for international orders. When paying by credit card, the amount is reserved on the card at the time of ordering.

Please note that if the package is not collected within the deadline at the Post Office (14 days), you will be charged for shipping both ways and an additional handling fee.

Customs duties and VAT in the recipient country are paid by the buyer. The buyer must be at least 18 years old, and this also applies to the recipient of the goods.

6. Delivery

Delivery of the goods will be made at the specified location and manner in the ordering process on the online store. The delivery time for small orders is usually 3-5 working days in Norway. For larger deliveries, the delivery time will vary, but this will be communicated. For international deliveries, the delivery time will vary based on the destination. Deliveries outside of Europe may take longer.

7. Risk of the Goods

The risk of the goods passes to you when the goods are received in accordance with the agreement. If you fail to take over the goods, you still bear the risk of loss or damage.

8. Right of Withdrawal

You have the right to withdraw from the purchase in accordance with the Norwegian Consumer Rights Act. The withdrawal period is 14 days after you receive the goods. The goods must be returned within 14 days after you have notified the use of the right of withdrawal. When using the right of withdrawal, the goods must be unused, in original packaging, and in the same condition as when you received them. You must cover the cost of the return shipping unless the seller has provided you with the wrong item or the item is defective.

To exercise your right of withdrawal, you must send written notice to the seller via email or letter, clearly stating that you wish to exercise your right of withdrawal. You can also use the standard withdrawal form available on our website. The seller will then provide you with instructions on how to return the goods.

9. Return Policy

If the goods you have received are incorrect, defective, or damaged, you have the right to return them within a reasonable time and claim a replacement or refund. Contact the seller as soon as possible after discovering the error, and follow the provided return instructions. The seller will cover the cost of the return shipping in such cases.

10. Privacy

By shopping on our website, you consent to our processing of personal data as described in our privacy policy. We protect your personal information and comply with applicable privacy laws.

11. Dispute

Any disputes arising from the purchase shall be attempted to be resolved amicably between the parties. If this is unsuccessful, the matter can be referred to the Consumer Council for mediation. If mediation is unsuccessful, the matter can be brought before the courts in accordance with applicable laws and regulations.

12. Changes to the Terms

The seller reserves the right to change these terms of purchase. Changes will take effect from the time they are published on our website. It is therefore important that you regularly check the terms before making a purchase.

13. Legal

We follow Norwegian laws and norms, and in the event of any disputes, Norwegian laws apply. This includes international transactions and trade.

14. Cancellation of Subscription/Pads Deal

If you have ordered pads for multiple deliveries and received a discount on the sheath as a result of such an order but wish to cancel the next delivery or "cancel the subscription," you can do so. You will then be invoiced for the discount you received on the sheath, and you must pay the remaining amount. Recommended prices without discounts apply.

Cancellation must occur 14 days before the next shipment and can occur no earlier than 40 days after the first pad delivery.

15. User guides and responsibility

All user guides are available online through the seller's website. The seller holds no responsibility for any use of the equipment that is in breach of the original intent or not according to the user manual.
